Article 1: General provisions
The e-commerce site of Nature’s Call (registrated BE 0896.685.816.) offers its customers the possibility to purchase the products online from the web shop. The present General Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the web shop, the Customer must explicitly accept the present Terms and Conditions. He hereby agrees to the applicability of the present Terms and Conditions, to the exclusion of any other terms and conditions. Additional terms and conditions of the Customer are excluded, unless they have been explicitly accepted in writing and in advance by ‘NATURE’S CALL’.
Article 2: Price
All prices mentioned are expressed in EUROS and always include VAT and all other taxes to be paid by the Customer. If delivery, reservation or administrative costs are charged, this will be stated separately. Additional postage costs may be charged for shipments to countries outside Belgium. The prices indicated exclusively relate to the items as literally described. Accompanying pictures are used by way of illustration only and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalogue and the e-commerce website were created with the utmost care, it is possible that the information provided is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind ‘NATURE’S CALL’. In terms of accuracy and completeness of the information provided, ‘NATURE’S CALL’ is only bound by a best effort obligation. ‘NATURE’S CALL’ can in no case be held liable for obvious material, typesetting or printing errors. If the Customer has specific questions about e.g. dimensions, colour, availability, period or method of delivery, we request the Customer to contact our customer service in advance. The offer is valid subject to availability of the product and can be changed or revoked by ‘NATURE’S CALL’ at any time. ‘NATURE’S CALL’ cannot be held liable for the unavailability of a product. If an offer is of limited duration or subject to conditions, this is explicitly mentioned in the offer.
Article 4: Online purchases
The Customer completes the online reservation form with his address and invoicing data.
The Customer can choose between the following methods of payment:
- by credit card
- by debit card
‘NATURE’S CALL’ is entitled to refuse an order due to serious non-performance by the Customer with respect to orders the Customer is involved in.
Article 5: Delivery and performance of the contract
Items ordered through this web shop are delivered to all countries. Delivery takes place by means of shipment through Bpost. Postage costs are charged to ‘NATURE’S CALL’, except for deliveries outside Belgium. Unless agreed or explicitly determined otherwise, the goods are delivered to the address of the Customer within 14 days after receipt of the order and the payment. Any visible damage and/or qualitative deficiency of an item or other defect upon delivery should be reported immediately to ‘NATURE’S CALL’ by the Customer. The risk of loss or damage shall pass to the Customer at the moment in which he (or a third party other than the carrier and indicated by the Customer) has acquired material possession of the goods. However, the risk shall pass to the Customer upon delivery to the carrier, if the carrier is commissioned to carry the goods by the Customer and that choice was not offered by ‘NATURE’S CALL’.
Article 6: Retention of title
The supplied goods remain the exclusive property of ‘NATURE’S CALL’ until fully paid by the Customer. The Customer undertakes to inform third parties of the retention of title on the part of ‘NATURE’S CALL’, e.g. anyone who would come to attach the items which have not been paid in full.
Article 7: Right of withdrawal
The provisions of this article only apply to Customers who purchase goods online from ‘NATURE’S CALL’ in their capacity as consumers. The Customer is entitled to withdraw from the agreement within a period of 7 calendar days without indication of reasons. The right of withdrawal ends 7 calendar days after the day on which the Customer or a third party other than the carrier and designated by the Customer acquires material possession of the goods. In order to exercise the right of withdrawal, the Customer needs to inform ‘NATURE’S CALL’ (Distelvinklei 19 Schoten 2900, info@naturescall.eu) of his decision to withdraw from the contract, by means of a clear statement (e.g. in writing by post, fax or email). For this purpose, the Customer can use the attached model withdrawal form, but this is not obligatory. To comply with the withdrawal period, the Customer needs to send the notification of exercise of his withdrawal right before the end of the withdrawal period. The Customer shall return or hand over the goods to ‘NATURE’S CALL’ (Distelvinklei 19 Schoten 2900) immediately, or, in any case, not later than 7 calendar days after the day on which his decision to withdraw from the contract was notified to ‘NATURE’S CALL’. The Customer is on time if he returns the goods before the end of the period of 7 calendar days. The direct costs of returning the goods are charged to the Customer. If there is, in any way, a decrease in the value of the returned product, ‘NATURE’S CALL’ reserves the right to hold the Customer liable and claim damages for any decrease in value of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to determine the nature, characteristics and of the goods. Only returns of items that are in their original packaging, together with all accessories, user manuals and an invoice or proof of purchase will be accepted. If the Customer withdraws from the agreement, ‘NATURE’S CALL’ will reimburse all payments received from the Customer up to that moment, including standard costs of delivery, to the Customer within 7 calendar days after ‘NATURE’S CALL’ has been informed of the decision of the Customer to withdraw from the contract. In case of sales contracts, ‘NATURE’S CALL’ may decide to withhold reimbursement until they receive all returned goods, or until the Customer proves that he returned the goods, whichever occurs first. Any additional costs resulting from the Customer’s choice for a method of delivery other than the cheapest standard delivery offered by ‘NATURE’S CALL’ will not be reimbursed. ‘NATURE’S CALL’ will reimburse the Customer using the same method of payment the Customer used for the initial transaction, unless the Customer explicitly agreed otherwise; in any case, no costs will be charged to the Customer for such reimbursement.
The Customer is not allowed to exercise the right of withdrawal for:
- delivery of newspapers, periodicals or magazines, with the exception of subscription contracts for the delivery of such publications;
- delivery of digital content which is not supplied on a tangible medium if performance of the services has started with the Customer’s prior express consent, and with acknowledgement by the Customer that he will lose his right of withdrawal (e.g. downloading music, software).
Article 8: Warranty
Pursuant to the Act of 21 September 2004 on the protection of the consumers, those consumers have certain legal rights when purchasing consumer goods. This legal warranty is valid as from the date of delivery to the first owner. Any commercial warranty does not affect these rights. In order to make a warranty claim, the Customer must be able to submit proof of purchase. Customers are recommended to keep the original packaging of the goods. For items purchased online and delivered to the Customer’s home, the Customer must contact the customer service of ‘NATURE’S CALL’ and return the item to ‘NATURE’S CALL’ at his own expense. If a defect is discovered, the Customer must inform ‘NATURE’S CALL’ as soon as possible. In any case, defects should be notified by the Customer within a period of one month after its discovery. After this period, there is no further entitlement to repairs or replacement. The (commercial and/or legal) warranty shall never apply to defects due to accidents, negligence, falls, use of the item for purposes it is not intended for, non-compliance with the user instructions or manual, changes or modifications made to the item, hard-handed usage, bad maintenance or any other abnormal or incorrect usage. Defects that appear after a period of 6 months from the date of purchase or delivery are not deemed to be hidden defects, unless the Customer can provide evidence to the contrary.

Article 10: Penalties for non-payment
Without prejudice to the exercise of any other rights granted to ‘NATURE’S CALL’, the Customer must pay an annual interest of 10% of the unpaid amount in case of non-payment or late payment, by operation of law and without any formal notice of default being required. Furthermore, the Customer has the obligation to pay a fixed compensation, by operation of law and without any formal notice of default being required, equalling 10% of the amount payable, with a minimum of € 25 per invoice. Without prejudice to the foregoing, ‘NATURE’S CALL’ reserves the right to take back the items that were not (fully) paid.
Article 11: Privacy
Responsible for processing, ‘NATURE’S CALL’ respects the Belgian Act of 8 December 1992 on the protection of privacy in relation to the processing of personal data. The personal data communicated by you will only be used for the following purposes: performance of the agreement entered into, processing of the order, sending of newsletters. You have a legal right to access or correct your personal date. Subject to proof of identity (copy of your identity card) you can receive a written statement of your personal data free of charge by means of a written, dated and signed request to ‘NATURE’S CALL’ (by post: Distelvinklei 19 Schoten 2900, by email: info@naturescall.eu ). If necessary, you can also ask to correct the data that are incorrect, incomplete or irrelevant. In case of use of data for direct marketing: You have the right to object, free of charge, to any further processing of your data for direct marketing. For this purpose, you can always address ‘NATURE’S CALL’ (by post: Distelvinklei 19 Schoten 2900, by email: info@naturescall.eu). We shall treat your data as confidential information and will never pass them on, rent or sell them to third parties. You are responsible for maintaining the confidentiality of your login data and password. Your password is encoded; therefore, ‘NATURE’S CALL’ does not have access to your password. ‘NATURE’S CALL’ keeps online (anonymous) visitor statistics to see which pages of the website are visited and with which frequency. Article 12: Use of cookies
During a visit to the site, cookies can be placed on the hard disk of your computer. Article 13: Infringement of validity – non-waiver
If any provision of the present Terms and Conditions is found to be invalid, illegal or void, this will not affect in any way the validity, legality and enforceability of the other provisions. The failure of ‘NATURE’S CALL’ to enforce any of the rights listed in the present Terms and Conditions or to exercise any of these rights at any time, will never be regarded as a waiver of these provisions and will never affect the validity of these rights.
Article 14: Changes to the terms and conditions
The present Terms and Conditions are supplemented by other terms and conditions specifically referred to, and by the general terms and conditions of ‘NATURE’S CALL’. In case of contradictions, the present Terms and Conditions shall prevail.
Article 15: Proof
The Customer accepts that electronic communications and backups can serve as proof.
Article 16: Applicable law – Disputes
The present terms and conditions are governed by Belgian law with the exception of the provisions of international private law regarding applicable law. The courts of the Consumer’s place of residence have jurisdiction in case of legal disputes. The Consumer can also address the ODR platform (http://ec.europa.eu/consumers/odr/).

This document describes the privacy policy of ‘NATURE’S CALL). It affects all data gathered and processed by ‘NATURE’S CALL’. This policy is a derivative of the GDPR, and is to be applied to ‘NATURE’S CALL’ activities, and ‘NATURE’S CALL’ data processing and data and information systems.

The GDPR is EU Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. ‘NATURE’S CALL’ as data owner and processor
‘NATURE’S CALL’ gathers personal data via several data and information systems and for a range of ‘NATURE’S CALL’ activities, such as the organisation of events. ‘NATURE’S CALL’ is the owner and processor of this data and does not pass on non public data on to third parties. All data gathered and processed by ‘NATURE’S CALL’ is subject to the EU General Data Protection Regulation (GDPR), which aims to protect the privacy of all EU inhabitants.

Complaints concerning the privacy policy of ‘NATURE’S CALL’, or concerning unlawful data processing by ‘NATURE’S CALL’, can be addressed to the Data Protection Authority (DPA) for Belgium (www.dataprotectionauthority.be). If there is a data breach, ‘NATURE’S CALL’ is bound to inform the DPA within 72 hours, and affected users – if identifiable – will also be notified.
Your rights as a data subject
A data subject is the natural person for whom personal data is processed. Each person has the right to be informed on what personal data is being processed and to have access to their personal data.
You have the right: to have your personal data corrected; to request a restriction or an end to processing of your data; and to be forgotten, which means the erasure of your personal data. Note that not all rights are absolute: ‘NATURE’S CALL’ can have compelling legitimate grounds that outweigh the interests and rights of the objector (accountancy, juridical reasons,…). When a request is made, ‘NATURE’S CALL’ may demand extra information to confirm identity. Note that the GDPR stipulates that each request made must be logged.
Legal grounds for data processing
There are several legal grounds for data processing. The most common is prior consent, which can be withdrawn at any time. A processing of data can be within agreement. Some of the services offered by ‘NATURE’S CALL’ require a personal account, and the processing of this data is limited to the linked services and is within agreement. ‘NATURE’S CALL’ has the legal obligation to process personal data for accountancy purposes, and has to keep this data for as long as is mandatory. ‘NATURE’S CALL’ also processes personal data for common interest: ‘NATURE’S CALL’ has the mandate to describe the marine scientific landscape in Flanders, and gathers professional data on scientists and institutes for this purpose.
Data processing by ‘NATURE’S CALL’
The ‘NATURE’S CALL’ privacy policy lists all data and information systems which process personal data. For some of the systems a more specific disclaimer is made, and direct contact details are given in the disclaimer. Questions can also be directed to info@naturescall.eu .
The basic principles of the GDPR is to keep the processing of personal data to a minimum – data privacy by design and by default – and to think about how to protect data from the beginning – data protection by design. To this end ‘NATURE’S CALL’ places its systems and data processing under scrutiny, and deletes data or renders it anonymous where possible.
‘NATURE’S CALL’ services requiring personal data
For some of the services and activities of ‘NATURE’S CALL’, an account and / or processing of personal data is necessary. By entering your personal data and / or creating an account you agree to the data processing. The following is a list of ‘NATURE’S CALL’ activities and systems which make use of personal data. This data is kept for as long as the agreement lasts, and at least as long as is required for legal purposes (e.g. accountancy). For purposes concerning proof in juridical disputes, ‘NATURE’S CALL’ may store personal data up to 10 years after the fact, which is the maximum legal term for placing personal claims.
Data quality by data provenance
Data quality is much improved by knowing the source and its level of expertise in the respective area and/or other relevant knowledge. For this reason ‘NATURE’S CALL’ can request for personal data (e.g. work experience, school degrees) to accompany data (in broad sense) offered to ‘NATURE’S CALL’. This provenance info, if made public, will not identify the data source unless allowed by the data subject.
Questions and remarks sent to ‘NATURE’S CALL’ via mail, web form or other media
‘NATURE’S CALL’ keeps a record of each data, library or information request it receives. This record includes the work-flow needed to answer the questions in a timely manner. These records, and other similar requests, are kept for statistical purposes. In the yearly overview, ‘NATURE’S CALL’ reports on the number of requests received and answered. The data are rendered anonymous/pseudonymous as soon as possible.
Note that questions and remarks sent to ‘NATURE’S CALL’ discussion fora and/or comments sections are posted publicly. This includes: the posted content and your name, but does not include provided contact info.
Visitor tracking on websites and cookies
‘NATURE’S CALL’ keeps logs of website visits – which contain: an IP address, time information, and the url visited – for bug tracking and to monitor for malicious visits. Along with the web-server logging, an anonymous visitor-tracking system is in place, to track which pages on the websites hosted by ‘NATURE’S CALL’ are accessed. We also use cookies to enhance the surfing experience (e.g. so visitors only have to log in or choose the language setting once). On each of our sites, we indicate that cookies are used and refer to our privacy policy.
Conference and other event participation
Registration is essential to participate in a ‘NATURE’S CALL’ event. This is for organisation purposes (to know the venue size, chose catering services, event payment,…) and to keep attendees informed on the programme. Each registration form has a GDPR section which allows attendees to subscribe to further communications by ‘NATURE’S CALL’ or to remove their data once the event has taken place (this is the default option). For each event, several e-mails may be sent as part of the communication agreement: save-the-date, posting of the tentative programme, abstract submission calls, closing of the early bird or final programme, and the closing e-mail with links to pictures taken and download links for presentations.
During our events, pictures are taken and on some occasions there is filming. It is extremely difficult to organise an opt-in system for photography and filming, therefore requests for the removal of photographs or films should be sent to the e-mail address used for event administration or to info@naturescall.eu. Photos in which the requester are shown will be removed from our web sites and servers; for films, the film segment will be cut out or the film deleted out if the requester is clearly visible.
Mailing lists organised or serviced by ‘NATURE’S CALL’
‘NATURE’S CALL’ manages mailing lists which were created to facilitate events, to allow for working-group communication, for partners in a project, etc. Each e-mail sent to these mailing lists contains an unsubscribe link and, for more information or the unsubscribe fails, a contact address. Unsubscribing is possible by sending an e-mail to info@naturescall.eu.
Personal data offered for job applications
Personal data offered in the context of job applications will be used solely for processing the application, unless consent was given for alerts on future job offers. The data will only be available to ‘NATURE’S CALL’ personnel handling the job offer and to the members the jury (‘NATURE’S CALL’ and/or external experts).
The emails and personal data received at infonaturescall.eu will be stored for 10 years for evidence purposes in case of juridical claims by the applicant.
In case of hiring, the personal data will be shared with SDworx, the social secretariat for ‘NATURE’S CALL’.
‘NATURE’S CALL’ systems making use of personal data
‘NATURE’S CALL’ web account
Many ‘NATURE’S CALL’ services are accessed via the ‘NATURE’S CALL’ web account or ‘NATURE’S CALL’ Single Sign On (SSO). Users create an account based on their e-mail address and with a password. All passwords are stored encrypted and thus ‘NATURE’S CALL’ does not have access to it. All login sessions are logged by the system. This allows for ‘NATURE’S CALL’ to report on the use of its services in its annual report.
‘NATURE’S CALL’ Photo Gallery
All pictures gathered by ‘NATURE’S CALL’ are archived in the ‘NATURE’S CALL’ photo gallery. This system allows for anyone to post pictures via the web site. During upload, personal data is requested to allow tracking of the source of the pictures. Note that the pictures in the ‘NATURE’S CALL’ photo gallery are made public unless specified otherwise. Everyone has access to the public pictures. It is the responsibility of the person posting the picture to be compliant with the GDPR, and to obtain the consent of the people portrayed.
A request for removal can be made on any page of the ‘NATURE’S CALL’ photo gallery, if you are logged in or by sending an email to the general ‘NATURE’S CALL’ information mailing address. Note that ‘NATURE’S CALL’ will check whether you are the person depicted, or if you have the legitimate right to demand removal.
Changes to the Privacy Policy
Please note that the ‘NATURE’S CALL’ Privacy Policy is reviewed periodically. ‘NATURE’S CALL’ reserves the right to modify its Privacy Policy at any time without notice.
